About End Point Royalties
As part of the National EPR Framework, members of the breeding community including breeding organisations, the GRDC and the seed industry have developed with industry a standardised agreement to licence new varieties to growers. The aim of standardising this agreement is to avoid confusion and reduce the number of different contracts currently being used to licence proprietary varieties to growers. The standardised agreements will increasingly be used by breeding organisations and their commercial agents to licence new varieties in the future. Replicate copies of the standardised agreement are on this web site and information about the Industry Standard PBR Licence Agreement can be found in the PBR Fact Sheet.

To view the Industry Standard PBR Licence Agreement template as well as the PBR Fact Sheet, scroll to the bottom of this page and click on the relevant link.

It is most important that growers realise that different companies controlling the use of plant breeders rights in new varieties can use different terms and conditions. Some key terms and conditions are contained in the schedules to PBR licence agreements.

For each variety that a grower purchases, the grower needs to check the terms and conditions of the agreement being used to licence the plant breeders rights to the grower, including the schedule to the agreement. If the Industry Standard PBR Licence Agreement is being used, growers should in time become familiar with the terms and conditions in the main body of this agreement because these terms and conditions will remain constant. However, the terms and conditions in the schedules will still vary from company to company and possibly from variety to variety.

Factsheets/Legislation

PBR Factsheet (4.96 MB, PDF)
To help balance the interests of owners of Plant Breeder’s Rights (PBR) and grain growers, members of industry have produced a standard seed licence agreement called the Industry Standard PBR Licence Agreement. The Industry Standard PBR Licence Agreement is for use between owners of plant breeder’s rights in new varieties (or their authorised agents) and grain growers. It is anticipated that the majority of PBR owners will switch to this agreement as they commercialise new varieties in the future.

Plant Breeder's Rights Act 1994
An Act to provide for the granting of proprietary rights to breeders of certain new varieties of plants and fungi, to repeal the Plant Variety Rights Act 1987, and for related purposes
