About End Point Royalties
As part of the National EPR Framework, members of the breeding community including breeding organisations, the GRDC and the seed industry have developed with industry a standardised agreement to licence new varieties to growers. The aim of standardising this agreement is to avoid confusion and reduce the number of different contracts currently being used to licence proprietary varieties to growers. The standardised agreements will increasingly be used by breeding organisations and their commercial agents to licence new varieties in the future. Replicate copies of the standardised agreement are on this web site and information about the Industry Standard PBR Licence Agreement can be found in the PBR Fact Sheet.
To view the Industry Standard PBR Licence Agreement template as well as the PBR Fact Sheet, scroll to the bottom of this page and click on the relevant link.
It is most important that growers realise that different companies controlling the use of plant breeders rights in new varieties can use different terms and conditions. Some key terms and conditions are contained in the schedules to PBR licence agreements.
For each variety that a grower purchases, the grower needs to check the terms and conditions of the agreement being used to licence the plant breeders rights to the grower, including the schedule to the agreement. If the Industry Standard PBR Licence Agreement is being used, growers should in time become familiar with the terms and conditions in the main body of this agreement because these terms and conditions will remain constant. However, the terms and conditions in the schedules will still vary from company to company and possibly from variety to variety.
Latest News
Ground Cover Issue 77 - November - December 2008 - EPRs designed to share risks and rewards
With 82 per cent of grain growers adopting a new variety in the past five years, the GRDC considers it important that breeders are developing varieties that meet growers’ real needs.

Factsheets/Legislation
PBR Factsheet (4.96 MB, PDF)
To help balance the interests of owners of Plant Breeder’s Rights (PBR) and grain growers, members of industry have produced a standard seed licence agreement called the Industry Standard PBR Licence Agreement. The Industry Standard PBR Licence Agreement is for use between owners of plant breeder’s rights in new varieties (or their authorised agents) and grain growers. It is anticipated that the majority of PBR owners will switch to this agreement as they commercialise new varieties in the future.
Plant Breeder's Rights Act 1994
An Act to provide for the granting of proprietary rights to breeders of certain new varieties of plants and fungi, to repeal the Plant Variety Rights Act 1987, and for related purposes
VarietyCentral
Variety Central is an information source for Australian grain growers and industry, encompassing plant breeding, seed commercialization, varieties, royalties and other relevant information. It is a joint initiative, developed by the EPR steering committee.
Australian Exporters Company (AEXCO)
Australian Exporters Company or AEXCO is a not for profit organisation that represents the majority of export hay processors located in South Australia, Western Australia, Victoria, and southern New South Wales. The company was formed to tender for commercialising rights for new oat hay variety releases.
Australian Grain Technologies (AGT)
Australian Grain Technologies (AGT) is Australia’s largest wheat breeding company. AGT and its predecessors have more than a century of experience in plant breeding, plant breeding related research, and commercial variety development.
Australian Seed Federation (ASF)
The ASF is focused on meeting the needs of its members by:
- Working for the development and improvement of agriculture and horticulture as such activities relate to the research, development, production, marketing and end use of sowing seed.
- Negotiating and cooperating with appropriate bodies in Australia and internationally on issues and decisions, which affect the seed industry.
- Promoting export trade in Australian produced seeds as a reliable producer and exporter of high quality seeds.
AWB Seeds
AWB Seeds is a division of AWB Limited, Australia's largest grain based agribusiness. AWB Limited plays a key role in the grains industry, and has a strong history in the marketing of grains both domestically and internationally.
ABB Seeds
ABB is involved in seed commercialisation through ABB Seeds, which owns seed commercialisation rights to 26 field crop varieties, across barley, wheat, pulses and oilseeds.
Barley Breeding Australia (BBA)
BBA coordinates Australia’s public barley breeding investment, underpinning a world competitive, cost effective, barley breeding program serving the needs of Australian barley growers, and domestic and international end users.
Canola Breeders Western Australia Pty Ltd
Canola Breeders Western Australia Pty Ltd represents a unique private partnership between growers, GRDC and The University of Western Australia, linked to international plant breeding and commercial expertise(NPZ). CBWA operates commercially and competitively to develop canola varieties that add value to the production chain and are the varieties of choice for growers in Western Australia, in other regions of Australia and in suitable environments internationally.
Council of Grain Grower Organisations (COGGO) Seeds
The Council of Grain Grower Organisations (COGGO) is an initiative of Western Australian grain growers committed to increasing the role of growers in directing, managing and financing the breeding of improved crop varieties.
Crop Care Seed Technologies
A newly formed division of leading crop protection company, Crop Care Australasia, Seed Technologies is now responsible for providing Australian farmers with a large proportion of new advancements in seed technology. Crop Care Seed Technologies has the ability to source new material from a vast genetic supply chain, encompassing all major Australian field crops along with many specialty and niche market crops.
Grainsearch
In 2002, 30 farmers in South West Victoria agreed to provide funding for five years to support a program to evaluate and multiply superior cereal varieties. Grainsearch Pty Ltd was formed and the farmers became shareholders.
HRZ Wheats Pty Ltd
CSIRO is developing high-yielding, disease-resistant, milling-quality wheat varieties for Australia's high rainfall zones, through its joint venture company HRZ Wheats Pty Ltd.
Intergrain
InterGrain's shareholders (the Government of Western Australia and GRDC), the InterGrain board, management of InterGrain and the Department of Agriculture and Food breeding team are all committed to building on previous success to provide a high-performance, cereal crop breeding service to the Australian grains industry.
IP Australia Plant Breeders Rights (PBR)
The official Australian site for Plant Breeder's Rights (PBR).Varieties protected by PBR may only be produced for sale, sold, imported, exported or conditioned with the authority of the owner. This page contains the plant varieties journal, PBR database, Interactive Variety Description System (IVDS) and examples of varieties using the PBR system.
LongReach Plant Breeders
LongReach’s national wheat breeding program is designed to deliver grain growers robust, high yielding and disease resistant varieties in each of the key production zones of the Australian wheat belt. This will also provide more consistent agronomic and quality performance across regions.
National Agricultural Commodities Marketing Association (NACMA)
NACMA, through its Committee system, develop and subsequently publish Trade Rules for grain contracts. These rules reflect trade practice and facilitate trade between members and overcome trade disputes by setting the ground rules before trading is initiated.
Pacific Seeds
